When a dispute was not resolved by Mediation, it usually meant there was no other option but to “give-up”, take what was offered or initiate expensive and lengthy litigation in the court system.

The recent Franchising Inquiry recommended that the dispute resolution scheme under the Franchising Code of Conduct remain mandatory and be enhanced to include the option of binding arbitration with the capacity to award remedies, compensation, interest and costs, if mediation is unsuccessful.
